The petitioner seeks bail in connection with Nawada Cyber P.S. Case No. 30 of 2025 instituted for the offence under Sections 303(2), 318(4), 318(2), 319(2), 336(2), 336(3), 338, 340(2) & 61(2) of the Bharatiya Nyaya Sanhita, 2023.

The prosecution case is that on 07.03.2025, Cyber Police, Nawada, acting on portal information regarding fraud through mobile no. 9041568976, conducted a raid at village Mir Bigha Badh. Two accused including the petitioner were apprehended and several mobile phones and SIM cards linked to cyber fraud were seized. It is alleged they duped people by

It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.05.2025. Petitioner bears no criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Learned counsel for the petitioner submits that save and except mobile phone, nothing has been recovered from the possession of the petitioner. Except suspicion, there is no cogent material against the petitioner. There is no compliance of Section 103 of the BNSS, 2023. The co-accused person has already been granted bail by this Court vide order dated 01.09.2025 passed in Cr. Misc. No. 58713 of 2025. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case and period of custody of the petitioner, this Court is inclined to grant bail to the petitioner.

8. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties
