JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner carries criminal antecedent of five cases including the present one and he is in jail custody since 18.06.2014 on the accusation that one country made pistol and three live cartridges were recovered from his conscious possession.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sikarahana at Motihari in connection with Patahi P.S. Case No. 51 of 2014 subject to

No.4299 of 2015 (2) dt.03-02-2015 condition that he shall attend the trial court on each and every date in person for the period of nine months or till conclusion of his trial whichever is earlier and if he fails to do so on two consecutive dates without any genuine cause, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner and furthermore, if any fresh case is instituted against the petitioner, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner after making proper and due enquiry..
