This application for anticipatory bail arises out of Ganga Bridge P.S. Case No. 34 of 2019 for the offence punishable under Sections 363 and 365 of the Indian Penal Code.

On the basis of the information received on 12.03.2019 in relation to an occurrence, which is said to have taken place on 21.01.2019, the First Information Report was registered. It is evident from the First Information Report itself that the petitioner and the informant are closely related (cobrother) to each other. It is alleged that the petitioner, duping the informant's wife on the false pretext of taking her to her ailing father, kidnapped her and the informant's daughter. Learned counsel appearing on behalf of the petitioner has submitted that there is no cogent explanation for

Patna High Court CR. MISC. No.45512 of 2019(3) dt.30-09-2019 2/2 delay of nearly two months in lodging of the First Information Report.

Considering the facts and circumstance, this application is allowed.

Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur, in Ganga Bridge P.S. Case No. 34 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
