The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 366(A)/34 of the Indian Penal Code. It is alleged that minor girl of the informant has been abducted by all the F.I.R named accused persons including the petitioner.

It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case since he is friend of co-accused Dhananjay Kumar. The victim in her 164 Cr.P.C statement has

No.58351 of 2021(3) dt.28-07-2022 2/2 recorded her age as 17 years and stated that co-accused Dhananjay Kumar forcefully solemonized marriage with her and thereafter continuously raped her without her consent. He has not disclosed the name of this petitioner in her 164 Cr.P.C statement. She has also not alleged any complicity of the petitioner in her elopement. In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari in connection with Muffasil P.S. Case No. 379 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
