JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 16-08-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Matihani P.S. Case No. 75 of 2022, registered for offence punishable under sections 326, 302/34 of the Indian Penal Code. The learned counsel for the petitioner has submitted that the witnesses examined during the course of trial did not support the prosecution case. The learned counsel has submitted further that including the informant altogether five witnesses have been examined and they all turned hostile, but some of the witnesses are yet to be examined.

The learned court below is directed to conclude the trial within a period of three months. If the trial is not concluded

Patna High Court CR. MISC. No.48783 of 2023(3) dt.16-08-2023 2/2 within a period of three months, the petitioner may renew his prayer for bail.
