JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 419, 341, 323, 324, 307, 504/34 of the Indian Penal Code.

The prosecution case is that the informant Arun Kumar was cleaning back side boundary of his house which was opposed by Ajay Prasad and his brother Natu then the informant claimed that the area belongs to him thereafter the accused persons, including the petitioner, being son-in-law of Bachu Prasad, came and assaulted him with sword.

It is submitted by the learned counsel for the petitioner that the main dispute was between the informant and Bachu Prasad and petitioner is son-in-law of Bachu Prasad. There is accusation of giving one sword blow and though one incised

Patna High Court Cr.Misc. No.7421 of 2016 (2) dt.19-02-2016 2/2 wound on the forehead of informant was found but the injury has been found to be simple in nature.

The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with Bihar P.S. case No. 588 of 2015 pending in the court of learned CJM, Nalanda at Biharsharif. This application is disposed of with the aforesaid observation/direction.
