The petitioner seeks regular bail in Navanagar (Basudewa O.P.) P.S. Case No. 221/2014 registered under Sections 363, 366(A)/34 of the Indian Penal Code. According to the prosecution case, the daughter of the informant left her house on 12.04.2014. She was recovered on 20.04.2014 with the petitioner but the petitioner was not arrested on that date.

Learned counsel for the petitioner submits that the present case was filed on 07.11.2014 but the victim is said to have been recovered on 20.04.2014. No case was registered on that date. Even the statement of the victim was not recorded. After seven months from the date of recovery of the victim, this case is filed.

Patna High Court Cr.Misc. No.3724 of 2015 (2) dt.29-01-2015 2/2 Considering the facts that even the case was filed after seven months of the recovery of the victim and the statement of the victim was not recorded, the above named petitioner is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in Navanagar (Basudewa O.P.) P.S. No. 221/2014.
