Petitioner is not named but in course of investigation, name of the petitioner surfaced and his confessional statement was recorded.

Allegedly, the stolen generator was recovered from possession of one co-accused Ranjeet Rai on the basis of confessional statement, made by the petitioner. Contention on behalf of the petitioner is that coaccused Ranjeet Rai has already been granted privilege of bail by a coordinate bench whereas; petitioner is in jail custody since 0304-2015.
