1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 363 and 365/34 of the Indian Penal Code.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and petitioner no. 1 is a woman and the informant alleges that Dheeraj on 02.06.2024 abducted her daughter aged about 19 years and accordingly she went to the house of Dheeraj to enquire when
Patna High Court CR. MISC. No.46332 of 2025(3) dt.15-11-2025 2/3 she was abused by the accused persons including the petitioner nos. 1 and 2.

Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant, it is next submitted that victim was in love with one Shiv Kumar and she eloped and has come back and her statement was recorded under Section 183 BNSS wherein she has not supported the case of prosecution rather has stated that she has married Shiv Kumar. It is further submitted that petitioner nos. 1 and 2, being related to Dheeraj, came to be implicated with general and omnibus allegation when Dheeraj had no role to play in the occurrence.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bathnaha
Patna High Court CR. MISC. No.46332 of 2025(3) dt.15-11-2025 3/3 P.S. Case No. 232 of 2024 subject to the conditions as laid down under Section 482 (2) of the BNSS.
7. Accordingly, the instant anticipatory bail application stands allowed.
