Petitioner is languishing in custody since 14.11.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 353, 323, 324, 307, 504, 506 of the Indian Penal Code, 25(1-B)a/26/37/35 of the Arms Act and 3/4 of the Explosive Substances Act.

It is alleged that the informant being the S.I. of police went to investigate Balia P.S. Case No. 247 of 2014 then all of a sudden the accused including this petitioner assaulted and abused the police personnel, resorted to firing and used explosives. On chase one Md. Salman apprehended with loaded pistol and cartridges, who disclosed the name of the petitioner.

It is submitted by the learned counsel for the

Patna High Court Cr.Misc. No.5375 of 2015 (2) dt.10-02-2015 petitioner that the accusation is not specific and the injury to the Home Guard Jawans have been found to be simple and superficial in nature and others have been granted bail vide Cr. Misc. No. 51232 of 2014.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Balia P.S. Case No. 248 of 2014.
