ANJANA MISHRA ORAL ORDER 04-02-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is an accused in connection with Bathnaha P.S. Case No. 273 of 2013 for the offence registered under Sections 363, 366A/34 of the Indian Penal Code. The bail application of the petitioner was earlier rejected by this Court on the sole ground that the victim girl is traceless. However, at present the circumstance has changed and the victim girl has been recovered.

No.3824 of 2015 (2) dt.04-02-2015 2/2 It is submitted on behalf of the petitioner that the victim girl in her statement recorded under Section 164 Cr.P.C. stated that she has gone with one Amitabh Bachhan Goisain and has been living with him as husband and wife. She has also disclosed her age about 18 years.

Considering the changed circumstances and also the fact that there is no cogent material to show that the petitioner had in fact kidnapped the victim girl, let the petitioner, above named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Sitamarhi in connection Sessions Trial No. 518 of 2014 arising out of Bathnaha P.S. Case No. 273 of 2013.
