In this case, the petitioner is seeking bail in connection with Awatar Nagar P.S. Case No. 24 of 2015 registered for offences under sections 341, 323, 324, 307, 354, 504, 506/34 of the Indian Penal Code and later on charge sheet has been submitted under sections 341, 323, 324, 307, 354, 376, 504, 506/34 of the Indian Penal Code.
As per the allegation, after the death of the husband of victim lady, the petitioner had developed relation with her and from that relationship a child was also born. The lady was pressing hard for the marriage but her father-in-law was not ready for the same.
Patna High Court Cr.Misc. No.7387 of 2016 (4) dt.11-04-2016 2/2 Allegation has been made that her father-in-law also assaulted the victim with iron rod, caused fracture injury on her hand.
So far allegation against the petitioner of developing relationship it appears that is consensual.
Looking to the facts and circumstances of the case, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri. Mahendra Prasad Yadav, Judicial Magistrate 1st class, Chapra (Saran) in connection with Awatar Nagar P.S. Case No. 24 of 2015.
