IN THE HIGH COURT OF JUDICATURE AT PATNA

Criminal Miscellaneous No.52617 of 2017 ====================================================== Rajo Mahto .... .... Petitioner/s

Versus

The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :

For the Petitioner/s : Mr. Shubhesh Pandey For the Opposite Party/s : Mr. Sri Parmanand Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 08-11-2017 Heard learned Counsel for the petitioner as well as the learned Counsel for the State.

Learned Counsel for the petitioner submits that the petitioner was granted anticipatory bail by this Court by order dated 2.9.2015 but he could not surrender within the stipulated period of four weeks as directed by this Court due to the ailment he was suffering from. However, there is no any statement given in the application as to what element he was suffering from or bedridden, rather the medical prescription shows that he was suffering from cough, fever and it is not the case that he was bedridden or admitted in the hospital for such a long period of more than two years.

So, there is no ground for extension of the period of surrender. The petitioner is directed to surrender and seek regular bail. The application stands disposed of.
