JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 13-02-2018 The petitioner is said to have passed Intermediate Examination, 2016, held by the Bihar School Examination Board. The Bihar School Examination Board has issued mark sheet, showing his result in the first division. There is a space in the said marks-statement, meant for photograph of the candidate, which is blank. The petitioner has a grievance that the correctness of the said marks-statement would become suspicious in the absence of the petitioner's photograph. Accordingly, this application has been filed seeking a direction to the Bihar School Examination Board to issue fresh marksstatement of the said examination with the petitioner's photograph.
Patna High Court CWJC No.2650 of 2018(2) dt.13-02-2018 2/2 Considering the grievance, which has been raised, this application is disposed of with a direction to the Secretary, Bihar School Examination Board, to consider issuance of fresh marksstatement after examining the records maintained by the Bihar School Examination Board. If it is because of no fault on the part of the petitioner that the said marks-statement has been issued without his photograph, a fresh marks-statement should be issued within a period of two months from the date the petitioner files his representation afresh along with a copy of this order.
This application stands disposed of.
It is clarified that the Secretary, Bihar School Examination Board, while examining the case of the petitioner, shall not go into the minor technicalities and if the Secretary is satisfied that the petitioner was genuine examinee of the said examination, he shall take steps for issuance of marks-statement with photograph.
