The petitioners apprehend their arrest in connection with Chandauti P.S. Case No.284 of 2016 registered under Sections 341, 323, 379, 307, 504 and 506/34 of the Indian Penal Code. The accusation is that the petitioners, who are son and daughter-in-law of the informant respectively, due to animal dispute, started to abuse the informant and his wife. When the informant asked that the animal belongs to him then both the petitioners started to scuffle with the informant. At that time, Uday Paswan and Satyendra Paswan also came and all caused injury to the informant and his wife through lathi and danda . At
Patna High Court Cr.Misc. No.55762 of 2017 (2) dt.04-12-2017 2/2 that time, the petitioner no.1, the son of the informant, took Rs.1500/- from the pocket of the informant and petitioner no.2, the daughter-in-law of the informant, took the silver Payal of the wife of the informant.
Learned counsel for the petitioners submits that the petitioners are son and daughter-in-law of the informant and due to land dispute, hot exchange of words and scuffle took place in between the petitioners and the informant and his wife. Moreover, the injuries, as found on the person of the informant and his wife, are simple in nature. The petitioners have no criminal antecedents.
Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Chandauti P.S. Case No.284 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
