====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 01-11-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
Learned counsel for the petitioner is expected to honour his undertaking to remove the defects, as pointed out by the office, when called upon to do so by the office. The petitioner is apprehending his arrest in connection with Dhaka P.S. Case No. 217 of 2020 for the offence registered under Section 409 of the Indian Penal Code. Allegation against the petitioner is of misappropriating the government money amounting to Rs. 12,00,000/- meant for Nal Jal Yojna.
Learned counsel for the petitioner draws the attention of the court towards Annexure -2 to this petition and submits
Patna High Court CR. MISC. No.1612 of 2021(3) dt.01-11-2021 2/3 that a cheque of Rs. 12 lakhs was handed over to the petitioner. It is further submitted that materials of Rs. 11,91717 has already been supplied by the petitioner for the work entrusted to him which fact has been acknowledged by the chairman of the said committee on the invoice of materials. Learned counsel for the petitioner further draws the attention of the court towards Annexure-3, from which, it appears that out of 12,00,000/-, the materials of Rs. 11,91,717/- has already been supplied and due to paucity of funds, the wages of labourer are not being paid due to which, the work was stopped. Learned counsel for the petitioner further draws the attention towards letter no. 22 dated 26.07.
21 (Annexure-5) issued by Office of Gram Panchayat Ram Karmawa, Block Dhaka, West Champaran. From perusal of which it appears that though the work has already been completed but the utility certificate is still awaited. Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest/surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M.
