Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 20-07-2021 Heard Mr. S.K. Lal, learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Teghra P.S. Case No. 189 of 2020 dated 08.07.2020 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.
Regard being had to the fact that the petitioner was earlier made accused in cases of similar nature, I am not inclined to grant anticipatory bail to the petitioner.
Accordingly, the prayer for anticipatory bail is rejected.
However, if the petitioner surrenders before the court below it shall be considered on its own merits and
Patna High Court CR. MISC. No.2754 of 2021(2) dt.20-07-2021 2/2 the court below shall also look into the fact that there is no recovery from the possession of the petitioner and the liquor is said to have been recovered from a vehicle which was found parked at a particular place and shall pass orders in accordance with law without being prejudiced by the fact that the present petition on his behalf has not been entertained.
