14-10-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offence under Sections 61(2), 103, 3(5) of the Bhartiya Nyaya Sanhita, 2023.

3. The informant has alleged that her husband was working as property dealer and on 18.12.2024, she received an information that her husband has been shot near Kamaldah Pokhar and when she along with other relatives brought him to Sadar Hospital, Buxar for treatment, where doctor declared him dead.

4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. Name of the petitioner transpired during course of investigation. The only material, which has come in paragraph 53 of the case diary, that he is

Patna High Court CR. MISC. No.49098 of 2025(3) dt.14-10-2025 2/2 associate of co-accused Vishal Tiwary, with whom, the deceased had enmity. At best, petitioner is alleged to be conspirator. There is no eye-witness to the alleged occurrence.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar in connection with Buxar (Town) P.S. Case No. 694 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) anay U T
