The petitioners seek bail in Bhagwanpur P.S. Case No. 76/2019, instituted for offences under Section(s) 147, 148, 149, 323, 307, 353 and 427 of the Indian Penal Code. Learned counsel for petitioners has submitted that there is general and omnibus allegation against these petitioners in the written report.

It is alleged in the written report that police raided the house of Madan Musahar to arrest him then his brother Surendra Musahar (petitioner no. 1) and one Prince Musahar (petitioner no. 2) tried to create hindrance. They called about 40

Patna High Court CR. MISC. No.46037 of 2019(2) dt.31-07-2019 2/2 persons and started brick batting causing injury to police personnel. They damaged the police vehicle. Thereafter police arrested both the petitioners. Other persons managed to run away.

Petitioners are in custody since 16.05.2019 having clean antecedent.

Considering the aforesaid facts and circumstances, prayer of petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate V, Kaimur at Bhabhua, in connection with Bhagwanpur P.S. Case No. 76/2019, subject to the conditions that both the bailors shall be the close relative of the petitioners.
