JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 16-08-2023 Heard Mr. Rama Kant Singh, learned counsel appearing on behalf of the petitioner; Mr. Sanjay Kumar Ghosarvey, learned AC to AAG-3 for the State and Mr. Arun Kumar Arun, learned counsel for the Accountant General.

2. Learned counsel appearing on behalf of the petitioner informs that petitioner has not been paid full amount of pension and gratuity for the reason that the disciplinary proceeding is pending against the petitioner. Petitioner has requested by making representation before the Additional Director General of Police, Budget, Appeal and Kalyan, Bihar,

3. Considering the submission made on behalf of the petitioner, the Director General of Police, Government of Bihar, Patna - respondent no.2 is directed to dispose of the representation of the petitioner within a period of six weeks.

4. The petitioner, if so advised, may file a fresh detailed representation before the respondent no.2 - The Director General of Police, Bihar and the respondent no.2 is directed to dispose of the representation of the petitioner ensuring that he will sanction 90% of the pension and gratuity to the petitioner during the pendency of the disciplinary proceeding, if any, pending against the petitioner. The remaining admissible dues is directed to be paid within a period of six weeks along with the statutory interest.

5. The writ application stands disposed of.
