JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-01-2015 Petitioners are languishing in custody since 15.11.2014 in a case registered for the offences punishable under Sections 344, 346, 366, 376, 34 of the I.P.C. It is alleged that son of these petitioners namely Karan Kumar Patel @ Tuntun abducted the informant, confined her in a room, established forceful physical relationship and forcefully married with her. It is alleged against these petitioners that they entered into the place of confinement and when the informant prayed for the rescue then they also threatened the informant.

It is submitted by learned counsel for the petitioners that from the statement of the victim it appears to be a case of love affairs when there are documentary proofs with regard to the marriage and some reconciliation between the parties from before.

Considering the thrust of accusation against Karan Kumar Patel @ Tuntun, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Mahila P.S.
