JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-07-2023 The present writ petition has been filed seeking the following reliefs:- "1.(a) To issue an appropriate writ/writs, direction/ directions including the writ of mandamus, commanding the respondents to remove the encroachment by excluding the land measuring about 1 Acre 31 decimal of R.S.Plot No.933 R.S. Khata No.630 of VillageDharupur under Bikramganj Nagar

Patna High Court CWJC No.3073 of 2013(5) dt.03-07-2023 2/3 Panchayat of Bikramganj Block in the district of Rohtas from the campus of Bikramganj Sub Jail, for which declaration of title and confirmation of possession has been decreed in favour of petitioner's father, Chandradeo Singh by the Additional Munsif, Bikramganj at Sasaram on 2.5.1991 in Title Suit No.96 of 1982/147 of 1990.

To issue an appropriate writ/writs, direction/directions to the respondents, to mutate and fix the rent for the area of land measuring about 1 Acre 54 Decimal of R.S.Plot No.933 R.S. Khata No.630 of Village Dharupur under Bikramganj Nagar Panchayat of Bikramganj Block in the District of Rohtas after excluding the area from Bikramganj Sub Jail Campus, for which declaration of title and confirmation of possession had been decreed in favour of petitioner's father, Chandradeo Singh by the Additional Munsif, Bikramganj at Sasaram on 2.5.1991 in Title Suit No.96 of 1982/147 of 1990."

At the outset, the learned counsel for the

Patna High Court CWJC No.3073 of 2013(5) dt.03-07-2023 3/3 petitioner seeks to withdraw the present writ petition with liberty to avail such other alternative remedies as are otherwise available under the law. Liberty so sought is granted.

The writ petition stands dismissed as not pressed.
