This application for grant of regular bail arises out of Harnaut (Telmar) P.S. Case No. 71 of 2019, registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

This is the third attempt on behalf of the petitioner to seek regular bail. On perusal of the First Information Report, it appears that the petitioner has been described to be the main assailant in the First Information Report, who had shot at the deceased from point blank range.

Considering the gravity of the offence and the nature of accusation, I am not inclined to grant petitioner privilege of regular bail for the present.

This application is accordingly rejected.

Learned Additional District and Sessions Judge-3rd,

Patna High Court CR. MISC. No.58199 of 2021(3) dt.22-12-2021 2/2 Nalanda at Biharsharif, has submitted to this Court a report as regards present stage of the trial arising out of Harnaut (Telmar) P.S. Case No. 71 of 2019, from which it appears that summonses have been issued to the witnesses, but prosecution witnesses have not been produced so far.

It is observed that let the trial before the Court below be expedited.
