The petitioner apprehends his arrest in connection with Masrakh P.S. Case No. 05 of 2015 registered under Sections 420, 467, 468, 471, 472 and 273/34 of the Indian Penal Code pending in the court of Chief Judicial Magistrate, Saran at Chapra. The accusation is of recovery of Jarkin containing 35 litres of country made liquor and five empty Jarkin from the hut of the petitioner whereas one plastic drum containing 200 litres of country made liquor and one other plastic durm containing 25 litres, three empty drums and four plastic Galan containing 25 litres of country made liquor are said to be recovered from the field of Bharat Sah belonging to this petitioner.
Patna High Court Cr.Misc. No.9403 of 2016 (2) dt.11-04-2016 Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
