JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 26-05-2021 Heard learned senior counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Section 354 (C) / 506 of the Indian Penal Code and Section 12, 14 of the POCSO Act. Allegation against the petitioner is that he along with others made obscene video of minor daughter of the informant and made it viral on social network.

Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He submits that there is general and omnibus allegation against the petitioner. He submits that there is delay of 8 days in lodging the FIR and no specific allegations with regard to commission of offence under POCSO Act is made out. He

Patna High Court CR. MISC. No.4615 of 2021(3) dt.26-05-2021 2/2 further submits that petitioner is languishing in judicial custody since 02.10.2020.

In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI, Rohtas at Sasaram in connection with Sheosagar P.S. Case No. 298 of 2020.
