2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Hussainganj P.S. Case No. 199 of 2019 instituted for the offence under Sections 147, 148, 149, 341, 323, 307, 332, 337, 353 and 427 of the Indian Penal Code.
3. The case of the prosecution is that police received information that certain miscreants have gathered. When the police party reached there, the informant found the petitioner and others they started pelting stones on the police vehicles and on the police personnel.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.46540 of 2025(2) dt.01-08-2025 2/3 petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Learned counsel for the petitioner has submitted that the nature of allegation is general and omnibus. It is not clear that who has identified the name of this petitioner. He has also submitted that similarly situated co-accused persons have been granted bail by a learned co-ordinate Bench of this Court vide order dated 31.01.2020 in Cr. Misc. No. 72662 of 2019. The case of this petitioner stands on similar footing. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent.
5. In contra, learned APP appearing for the State has vehemently opposed the prayer of bail of the petitioner.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Hussainganj P.S. Case No. 199 of 2019, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
