The petitioner has preferred this application for grant of regular bail in a case registered under sections 385 and 387 of the Indian Penal Code.

As per the prosecution case, a demand of rangadari of Rs. 2 crores was made from the informant by one Pintu Rana, a member of the MCC.

It is submitted by learned counsel for the petitioner that the FIR was registered against the holder of the mobile number from which the demand was made. It is submitted that from the order of the learned Court below it would transpire that the petitioner was falsely implicated in course of investigation. Patna High Court CR. MISC. No.59285 of 2021(2) dt.01-02-2022 2/2 is her confessional statement. Even as per the FIR the extortion call was not made by her. In her statement she has stated that although the mobile was registered in her name but the same was being used by one Guddu Mahto. The petitioner is in custody since 8.7.2021 and has no criminal antecedent. Charge sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner being in custody for 6 months and having no criminal antecedents, the Court directs the petitioner to be enlarged on bail in connection with Kotwali (Tilkamanjhi) P.S. Case no. 422 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur.
