Mr. Akhileshwar Singh, ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 05-01-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Hulasganj P.S. Case No. 94 of 2016 instituted for the offence under Section-135 of the Electricity Act.

It has been submitted that the petitioner is ready to deposit the amount as mentioned in the written report in 7 equal installments to the electricity department.

In such circumstances, this anticipatory bail petition is disposed off with direction to the petitioner to surrender in the court below within four weeks from the date of receipt of copy of this order with valid receipt showing deposit of Rs. 5,000/- and thereafter, the petitioner will be granted provisional anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Hulasganj P.S. Case No. 94 of 2016 to

Patna High Court Cr.Misc. No.48647 of 2017 (8) dt.05-01-2018 2/2 the satisfaction of learned Special Judge, Electricity, Gaya. The petitioner will make payment of remaining amount in six equal installments and after producing valid receipt showing payment of entire amount, his provisional anticipatory bail will be confirmed.

It is made clear that in the event the petitioner does not appear with valid receipt as ordered above or makes default in making payment of single installment as per order above, the court below will be at liberty to pass appropriate order in accordance with law including cancellation of provisional bail of the petitioner.
