JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-03-2016 Heard learned counsel for the petitioner as well as the learned counsel for the informant and learned Additional Public Prosecutor for the State.

Petitioner happens to be husband of the informant and it is admitted case of the prosecution that the matrimonial dispute was going on between the petitioner and informant at the time of institution of the present case.

Learned counsel for the petitioner points out that petitioner had filed a suit for divorce and after that, the informant filed a criminal case for the offence under section 498A of the Indian Penal Code against the petitioner and when petitioner got bail in the aforesaid case, the informant has brought this false case. On the other hand, learned counsel appearing for the

Patna High Court Cr.Misc. No.8689 of 2016 (2) dt.01-03-2016 2/2 informant submits that petitioner and other accused had come to the house of the informant to pressurize her for withdrawal of the criminal case lodged against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate - IInd Araria in connection with with Bhargama P.S.case No. 215 of 2015.
