1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 132, 109, 310(5) and 310(4) of the BNS as well as Sections 25(1-B)(a), 26, 27 and 35 of the Arms Act.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that he received information that miscreants are arriving with an intention to commit loot, accordingly, the police force reached the place of occurrence then they saw six accused persons on two motorcycles who on seeing the police started fleeing but were intercepted by the police, hence, they resorted to firing. The police in counter also fired thereafter three

Patna High Court CR. MISC. No.51813 of 2025(2) dt.12-08-2025 2/3 accused were caught, namely, Rohit, Alok and Vikash out of whom one accused received gun shot injury and from Rohit arms were recovered.

4. Learned counsel for the petitioner submits that petitioner was not even present at the place of occurrence and he came to be implicated based on the confessional statement of apprehended accused. It is further submitted that similarly situated co-accused, namely, Ujjawal Paswan had approached this Court seeking anticipatory bail by filing Cr. Misc. No. 41534 of 2025 and the same was allowed by an order dated 09.07.2025 passed by a learned Co-ordinate Bench of this Court. Learned counsel thus based on parity seeks anticipatory bail.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case

Patna High Court CR. MISC. No.51813 of 2025(2) dt.12-08-2025 3/3 is pending/Successor Court in connection with Kamtaul P.S. Case No. 22 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS.

7. One of the bailors of the petitioner shall be his father, namely, Sudhir Mishra.
