2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 109, 132, 223 and 3(5) of the B.N.S..
3. As per prosecution case, it is alleged that this petitioner, along with other accused persons, assaulted police personnel as a result of which, some police personnel sustained injuries and thereafter, fled away with the vehicle.
4. It is submitted by learned senior counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is not named in the F.I.R.. Allegation of assault is general and omnibus and no specific
Patna High Court CR. MISC. No.49127 of 2025(2) dt.19-08-2025 2/2 accusation of overt act has been alleged against this petitioner. Petitioner claims clean antecedents.
5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that there is specific accusation that all the accused persons, assaulted police party as a result of which several police personnel sustained injuries, created hindrance in discharge of their official duties and fled away with the vehicle.
6. Considering the facts and circumstances of the case and nature of accusation, the prayer for grant of anticipatory bail to the petitioner is rejected.
