The petitioner seeks bail in a case instituted for the offences under Sections 467, 468, 471, 409 and 420/34 of the Indian Penal Code.
Petitioner is the Headmaster. Allegation has been made that he has misappropriated the money meant for student which was allocated for dress and scholarship. It has been alleged that he has misappropriated Rs.1,86,000/-. He is ready to deposit 50% of the aforesaid amount within 60 days. Having considered the facts and circumstances of the case, let petitioner, Binay Kumar Vinayak, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with
Patna High Court Cr.Misc. No.7569 of 2016 (3) dt.12-04-2016 two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger in connection with Bariyarpur P.S. Case No.134 of 2015, subject to the conditions that (i) one of the bailors shall be a close relative of the petitioner and (ii) petitioner would deposit Rs.25,000/- at the time of bail and rest will be deposited within a period of 60 days. Period of sixty days will be treated to be on provisional bail but after deposit of the aforesaid amount he will be treated to be on confirmed bail. In failure to deposit the aforesaid amount within the aforesaid period, order of bail to be treated to have been withdrawn.
