Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of I.P.C. Petitioner allegedly caused injury with bamboo stick to the son of the informant at his head which resulted in death. Petitioner is in custody since 12.11.2018.

In the past, prayer for bail was refused on 08.08.2019 with direction to the learned Trial Judge to expedite the trial and liberty to the petitioner to renew prayer after nine months if the trial is not concluded.

It has been informed that the trial is at the stage of prosecution evidence.

Considering the period already undergone by the petitioner and no material to substantiate that the petitioner is going to tamper with the evidence or could be non-cooperative

Patna High Court CR. MISC. No.3301 of 2021(4) dt.28-06-2021 2/2 in the trial, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Hayaghat Police Station Case No.102 of 2018 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
