JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-02-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are in jail custody since 04.12.2014 in a case registered for the offences punishable under Sections 369, 370A, 370(5)/34 of the Indian Penal Code and Section 23/24 of J.J.C. & Protection of Children Act.

Petitioners were caught by the police while they were carrying some children for getting them engaged in bounded labour system.

Submission on behalf of the petitioners is that the children were being carried by the petitioners for getting them admitted in Madarsa and moreover, the parents of the aforesaid

Patna High Court Cr.Misc. No.5643 of 2015 (2) dt.12-02-2015 children have already sworn affidavit to the above stated effect. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Kursakanta P.S. Case No. 165 of 2014.
