JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-04-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of victim is languishing in custody since 16.09.2015 in a case registered for the offences punishable under sections 498A, 302, 201/34 of the IPC.

The prosecution case is that after 15 years of marriage the informant's sister was killed and her dead body was recovered from a pond on the information supplied by the petitioner that the dead body is floating in a pond.

It is submitted by learned counsel for the petitioner that the victim died after 15 years of her marriage and there is no eye witness to the occurrence and none of the witnesses have

Patna High Court Cr.Misc. No.8525 of 2016 (5) dt.18-04-2016 2/2 suggested that they saw the victim being assaulted by any accused or pushing her dead body in the pond.

Mr. J. N. Thakur, learned APP, after going through the case diary, submits that admittedly there is no eye witness to the occurrence but since the victim was issueless, it was suspected that the petitioner got her killed.

Considering the fact there is no eye witness to the occurrence and investigation has already been concluded, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Bikramganj, Rohtas, Sasaram in connection with Sanjhauli P.S. Case No. 87 of 2015.
