JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 06-11-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State as also the learned counsel for the opposite party no.2.

The petitioners apprehend their arrest in connection with Chakia P.S. Case No.154 of 2017 registered under Sections 353 and 504/34 of the Indian Penal Code.

The accusation against the petitioners is of creating disturbance in fixing the electric pole for running the cable of

Patna High Court Cr.Misc. No.51821 of 2017 (2) dt.06-11-2017 2/3 11000 Volt.

Learned counsel appearing on behalf of the petitioners submits that, in fact, the pole was being fixed in the villageGhanghti Fulwaria for running the cable of 11000 Volt but the pole was being fixed for running the cable of 11000 Volt over the house of the some villagers regarding which the petitioners and other villagers made complaint before the Junior Electrical Engineer, Electric Supply Sub Division-Chakia, Motihari, East Champaran, and also gave an application to the Officer Incharge, Chakia Police Station, East Champaran. Due to that reason, only to put pressure upon the petitioners, the informant, who is the Assistant Electrical Engineer, Electric Supply Sub DivisionChakia, has lodged this false case. The petitioners have no criminal antecedents.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-13, Motihari, East Champaran, in connection with Chakia P.S. Case No.154 of 2017, subject to the conditions laid down under Section
