====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 10-02-2022 Heard learned counsel for the petitioner, complainant and learned APP for the State.
Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.
The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 406, 420 of the Indian Penal Code.
It is alleged by the informant that relative of
Patna High Court CR. MISC. No.9147 of 2021(3) dt.10-02-2022 2/3 this petitioner namely Shashi Ranjan Kumar demanded Rs. 20,000/- from the informant for releasing first installment of Rs. 45,000/- under Prime Minister Housing Scheme.
It is submitted by learned counsel for the petitioner that petitioner is Gramin Awaas Sahayak and at the instance of Mukhiya this false case has been registered against the petitioner. The F.I.R itself suggests that informant has not given any money to the petitioner. Moreover, for the alleged occurrence of 07.03.2020, the F.I.R has been registered on 12.03.2020.
Considering the aforesaid facts, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate,
Patna High Court CR. MISC. No.9147 of 2021(3) dt.10-02-2022 3/3 Aurangabad in connection with Risiup P.S. Case No. 22 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
