The petitioner apprehends his arrest in connection with Saharsa Sadar P.S. Case no. 434 of 2017, registered under Sections 304-B and 201/34 of the Indian Penal Code.
The accusation is of killing of the sister of the informant, whose marriage was performed before 12 years by administering poison by her husband and other in-laws due to non-fulfillment of demand of dowry.
Learned counsel for the petitioner submits that petitioner is the brother-in-law of the deceased and he used to reside separate from the husband of the deceased, but with ulterior motive, he has falsely been implicated in this case. Further submission is that petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case,
Patna High Court Cr.Misc. No.51506 of 2017 (2) dt.02-11-2017 2/2 let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 434 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
