The petitioner has preferred this application for grant of regular bail in a case registered under section 414 of the Indian Penal Code and sections 30(a)(d) and 41 of Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, four accused persons on two motorcycles were carrying illicit liquor. 100 litres of illicit liquor was recovered. Subsequently, further raid was conducted and 3000 litres of illicit liquor and manufacturing articles etc. were found but the accused persons fled away. This petitioner was identified among accused who managed to flee away. It is submitted by learned counsel for the petitioner that neither the petitioner was arrested at the spot nor any incriminating article has been recovered from his possession. He

Patna High Court CR. MISC. No.58651 of 2021(2) dt.11-04-2022 2/2 is in custody since 16.07.2021 and charge sheet has been submitted in this case.

Having heard learned counsel for the parties and taking into consideration the fact of the petitioner not having been arrested at the spot and having remained in jail custody for eight months , the Court directs the petitioner to be enlarged on bail in connection with Rajauli P.S. Case no. 356 of 2021 on furnishing bail bond of Rs 10,000/ (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum- Special Judge, Nawada.
