2. The accused/petitioner seeks bail in connection with RC Case No. 07(A) of 2025 registered for the offences under Sections 7, 8, 9, 10 and 12 of the Prevention of Corruption Act and section 61(2) of the Bhartiya Nyay Sanhita, 2023 (in short, the 'B.N.S.').

3. The accused/petitioner is named in the First Information Report and is in custody since 23.03.2025.

As per FIR, upon raid by CBI, unaccounted money of Rs. 1.18 Crore was recovered from the house of the petitioner, where primarily CBI raided the premises upon secret information that petitioner is in process to receive bribe of Rs. 15 Lakhs from one contractor against favour in road construction work in Muzaffarpur District.
5. Mr. Y.C. Verma, learned senior counsel appearing on behalf of the petitioner, submitted that this is not a trap case. It is submitted that allegation of corruption is also not available against this petitioner. It is pointed out by Mr. Verma that as upon raid by CBI, huge cash of Rs. 1.18 Crore was recovered from the house of petitioner which is given to him by his friend namely, Nitesh Kumar for short period, who is a businessman, the present false case was raised. It is pointed out that the matter is purely related with income tax and even for that the amount recovered is well explained in terms of supplementary affidavit as filed by the petitioner on 16.10.2025.

6. Arguing further, it is submitted by Mr. Verma that petitioner is a man of clean antecedent and, moreover, investigation of this case is already concluded, for which charge-sheet has been submitted and as such, there is no chance of tampering with the evidence.
7. Learned A.P.P. for the State has opposed the prayer for bail of the petitioner.
8. Mr. Manoj Kumar Singh, learned counsel appearing for the CBI, while opposing the prayer of bail of the petitioner, submitted that recovery of huge amount of money raised a question to the conduct of the petitioner.

In view of aforesaid factual submission and by taking note of the fact as prima facie the factual aspect of this case suggests that it is not a trap case facing charge of corruption, rather it is a case of recovery of Rs. 1.18 Crore for which primarily the explanation appears furnished by the petitioner on oath through supplementary affidavit dated 16.10.2025, coupled with the fact that petitioner, who is a man of clean antecedent, remains in custody since 23.03.2025, where investigation of this case is already
4/4 completed, accordingly, above-named petitioner is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge, CBI-II, Patna/concerned court, in connection with RC Case No. 07(A) of 2025, subject to the condition as laid down under Section 437(3) Cr.P.C/Section 480(3) of the Bhartiya Nagarik Suraksha Sanhita (in short "B.N.S.S.").
