2. The petitioner is in custody since 05.01.2015 in connection with Naubatpur P.S. Case No. 291 of 2014 for the offences alleged under Sections 302/201 of the Indian Penal Code.

3. It is submitted that the petitioner has been implicated on false premise and mere suspicion and he has not been named in the F.I.R. Similarly situated co-accused Dhiraj Kumar has been granted bail by this Court in Criminal Miscellaneous No. 45474 of 2014.

4. Having regard to the entirety of the facts and circumstances of the case, let the petitioner Sanjay

Patna High Court Cr.Misc. No.3575 of 2015 (3) dt.04-03-2015 Kumar be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of Sri Madhavendra, learned Judicial Magistrate, 1st Class, Danapur, Patna in connection with Naubatpur P.S. Case No. 291 of 2014, with condition that the petitioner shall remain physically present in Court on each and every date during trial and in the event of failure on two consecutive dates, his bail bond shall be liable to be cancelled by the learned Court concerned.
