The petitioner seeks bail in a case registered under Sections 341, 448, 323, 325, 302, 504, 120B of the Indian Penal Code and 27 of the Arms Act and Sections 10, 13, 16, 18, 20 of U.A.P. Act.
Prosecution case, in short, is that on 12.02.2018 at 7 p.m. S.P.O. Tirthraj Ram given information that Maobadi have attacked on home of Mukhiya Manoj Singh. Thereafter the informant informed the higher authority and went to place of occurrence with other police personnel and saw that murder of Manoj Singh was committed by Maobadi. The son of deceased and labourers were present there and told that in the meantime
Patna High Court CR. MISC. No.45892 of 2019(2) dt.24-07-2019 2/2 10.15 Maobadi along with three ladies came with arms and gun and gun shot was given, as a result deceased died on the spot. It has been submitted on behalf of the petitioner that the petitioner is in custody since 5.3.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. No specific allegation has been made against the petitioner. General and omnibus allegation has been made. Neither any specific overt act is alleged against the petitioner nor any specific injury is attributed against the petitioner.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sonu Kumar, J.M. 1st class, Bagaha, West Champaran in connection with Valmikinagar P.S. case No.64 of 2018.
