The petitioner apprehends his arrest in connection with Chiraiya (Shikarganj )P.S. Case No. 09 of 2017 registered under Sections 307, 414/34 of the Indian Penal Code and Section 25(1-b)a, 26, 27, 35 of the Arms Act.
Learned counsel appearing on behalf of the petitioner submits that petitioner has been falsely implicated in this case. Similarly situated co-accused has been granted anticipatory bail by another co-ordinate Bench of this Court in Criminal Miscellaneous No. 51912 of 2017 on 10.11.2017. Petitioner has no criminal antecedent.
Having considered the facts and circumstances of the
Patna High Court Cr.Misc. No.50082 of 2017 (3) dt.01-12-2017 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Sikrahana at Chaka, East Champaran, Motihari in connection with Chiraiya (Shikarganj) P.S. Case No. 09 of 2017 subject to the condition as laid down under Section 438(2) of the Cr.P.C.
