The petitioner is accused in connection with Laukhi P.S.Case No. 70/11, G.R. No. 1066/2011 registered under Sections 302/34, 120 (B) and 27 of the Arms Act.3.,201 and 34 of the I.P.C.

The prosecution case is that on 30.09.2011 at 9-10 P.M. three persons named in the F.I.R. including the petitioner and some unknown entered into house of informant Bhim Narain Sah and enquire about Bhim then Ram Narain Sah, brother of informant told that he had gone to Madhubani. Thereafter, three persons, named in F.I.R. including the petitioner accompanied to

Patna High Court Cr.Misc. No.13611 of 2016 (2) dt.11-04-2016 2/2 Ram Narain Sah , brother of informant on pretext of talk but near Brah Asthan he was shot dead.

Learned counsel appearing on behalf of the petitioner submits that while the petitioner is named in F.I.R. with two known accused and some unknown but there is no specific allegation against the petitioner to shot fire at the deceased. Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, above named, I am not inclined to grant regular bail to the petitioner. Accordingly, the prayer of the bail of petitioner stands rejected. (Rajendra Kumar Mishra, J) Sudha/- U T
