Thakur (App) ====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-05-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the victim is languishing in custody since 11.9.2015 in a case registered for the offences punishable under Sections 498A, 328 and 302/34 of the Indian Penal Code.
The accusation is of administering poison and assaulting the sister of the informant who subsequently succumbed to the injury though the postmortem report reflects the cause of death as injury caused by hard and blunt substance. The viscera report has not been received.
It is submitted by the learned counsel for the petitioner that the victim was residing at her parents' house as she was a
Patna High Court Cr.Misc. No.9902 of 2016 (4) dt.16-05-2016 2/2 teacher and while she was coming from school she met with a road accident. It is further submitted that there is no eye witness to the occurrence. Learned APP, after going through the case diary, concedes that no eye witness account of any witness has been recorded by the I.O. Co accused have been granted bail by a coordinate bench of this court vide Cr. Misc. No. 37021 of 2015. Considering the aforesaid facts and the fact that the investigation has already concluded, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, West Champaran, Bettiah in connection with Lauriya P.S. Case No. 122 of 2015.
