17-10-2017 Heard Sri Sudhir Kumar Singh, learned counsel for the petitioner and Sri Dinesh Singh, learned Addl. Public Prosecutor.

The sole petitioner, apprehending his arrest in Brahmpur P.S. Case No. 260 of 2017 registered for offence under Section 30A of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender.

It was submitted by learned counsel for the petitioner that without any cogent material, the petitioner has been made accused. He submits that it is a peculiar case, in which, police had noticed one person near the house of the petitioner and after noticing police, after throwing a bag containing 8 liters of country-made liquor, he fled away and subsequently, the

Patna High Court Cr.Misc. No.49716 of 2017(2) dt.17-10-2017 2/2 petitioner was made accused, since the recovery was effected near his house. He further submits that the petitioner is having clean antecedent, which fact has been stated in paragraph - 3 of the petition.

Considering the facts & circumstances as well as clean antecedent of the petitioner, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Sunil Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. IInd-cumSpecial Judge, Excise, Buxar in connection with Brahmpur P.S. Case No. 260 of 2017, subject to condition as laid down under Section 438(2) of the Cr.P.C.
