JUSTICE MUNGESHWAR SAHOO ORAL ORDER 16-01-2017 Heard the learned counsel for the appellant as well as learned counsel for the respondents on the Compromise Application i.e., I.A. No. 6272/2016.
This First Appeal arises out of preliminary decree in partition suit. The parties have compromised outside the Court and have filed a compromise application mentioning the terms and conditions of the compromise. The property has already been divided between them and separate schedules have been mentioned in the compromise application. Both the parties accepted the fact that they came in possession of their respective allotted properties.
Patna High Court FA No.153 of 2005 (19) dt.16-01-2017 2/2 In view of the aforesaid submission of the learned counsel for the parties and in view of the admitted position, there is no impediment in the way of recording compromise between the parties and accordingly, I am satisfied that the compromise application filed by the parties is according to law and therefore, the compromise application is accepted.
Let a final decree will be prepared on the basis of the compromise and the compromise application i.e., I.A. No. 6272/.2016 shall part of the decree.
This First Appeal is, thus, allowed in terms of the compromise.
