2. In this case, the petitioner is seeking regular bail in connection with S.T. No. 116 of 2024 arising out of Kotwali P.S. Case No. 1028 of 2023, registered for the offences punishable under Sections 341, 323, 324, 307, 504, 34 of the Indian Penal Code.
3. As per allegation, the informant had gone to visit fair (Mela) and about 11.00 P.M. when he was returning to his house, the petitioner along with other accused persons came there and demanded his mobile phone and on objection, they started abusing and assaulting him. Further, co-accused Dimba Yadav and Vishnu Yadav stabbed knife in the stomach of the
Patna High Court CR. MISC. No.49868 of 2024(2) dt.24-07-2024 2/2 informant due to which he fell down.
4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He is a person of clean antecedent and he is under custody since 13.11.2023. He further submits that he is neither the order giver nor the assailant of the injury.
5. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge X, Bhagalpur in connection with Kotwali P.S. Case No. 1028 of 2023, subject to the following condition:- The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
