The petitioner apprehends his arrest in a case registered for the offence under Sections 379, 120B, 406, 411 of the Indian Penal Code.

It is alleged that this petitioner and other accused persons attempted to take away the truck, loaded with stonechips, from the road side adjacent to the police station premises. It is submitted on behalf of petitioner that petitioner is owner of the truck in question and allegation of stealing the truck is baseless and concocted. The truck in question has been seized by the police and is still in possession of the police. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

No.48316 of 2022(2) dt.13-12-2022 2/2 Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur in connection with Industrial P.S. Case No. 77/2022 Bhagalpur (G.R. No. 1758/2022), subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
