2. The petitioner has filed this bail application in connection with Bhore P.S Case No. 5139006260177 (177) of 2026 registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016 (as amended up-to-date).
3. As per the prosecution story, there was a recovery of 126.48 liters of foreign liquor from the car. Admittedly, the petitioner is not the owner of the seized car. He was driver of the car and he has nothing to do with the alleged wine that has been recovered.
4. It has been submitted on behalf of the petitioner that the petitioner is innocent and has been falsely implicated in this case due to high-handedness of the police and no incriminating material has been recovered from the conscious possession of the petitioner. Further, it is stated that the petitioner is neither the owner nor the trader of wine.
5. The petitioner is having a clean antecedent and is in
Patna High Court CR. MISC. No.48819 of 2026(2) dt.22-07-2026 2/2 judicial custody since 31.03.2026.

Considering the aforesaid facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise Court No. 1, Gopalganj in connection with Bhore P.S Case No. 5139006260177 (177) of 2026 on the following conditions:- (i) That one of the bailor should be family member of the petitioner.
(ii) That the petitioner will cooperate in the trial and will remain present on all dates personally or should be duly represented through his counsel and whenever required to be physically present by the Court, he should physically appear in Court on that date. (iii) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
